Discusses the courts' approach to the division of property, especially in a context where property has been conveyed into the joint names of cohabitees and their relationship has broken down, the Stack v Dowden judgment in the House of Lords. Among other things, the article examines the principle that the onus is generally upon the person seeking to show that the parties intended their beneficial interests to be different from their legal interests, and in what way.
