The paper considered issues around the government's developing 'flexible working' agenda, including effects on the employment protection regime. It examined 'dignity' as an evolving discourse in the literature and as a strand of implied terms, and in the expectation that trust and confidence is an essential component of the modern employment contract that must be maintained. Other issues addressed included new processes and procedures superimposed on the unfair dismissal regime by the Employment Act 2002, and inroads made into Polkey 'fairness' requirements.
