Abstract or description

In the Asian region, human rights defenders (HRDs) are often seen as ‘enemies’ rather than strategic allies of the state, and they face critical challenges for several reasons including the absence of resilient civic space and the rise of authoritarian populism. This paper examines the crucial role of HRDs in Asia in enhancing international human rights law and explores their complex relationship with civic space and state power. It argues that owing to the unique political dynamics across various Asian countries, the interaction between governmental authority and civil society emerges as a significant factor in shaping the human rights landscape. It also argues that the concept of civic space and its integrity is often threatened by state actions that seek to suppress dissent and limit freedom of expression. To substantiate these arguments, this paper draws examples from multiple Asian countries including Bangladesh, India, and Pakistan, and analyses how HRDs: 1) navigate challenges and engage with international human rights law to advocate for stronger protections at both national and regional levels; and 2) highlights the diverse strategies to resist authoritarian tendencies, mobilise public support, and foster dialogue with state actors. In conclusion, this paper emphasises the importance of coalitions among local, regional, and international actors to amplify their voices and influence policy reforms. In addressing the political dynamics, the paper also offers insights into the shifting power relations between state and non-state actors, and their implications for civic engagement and human rights advocacy in the region. The significance of this paper lies in exploring the broader discourse on human rights by providing a nuanced understanding of the challenges confronted by HRDs, unearthing the politics of resilient civic space, and construing the potential pathways for fostering a more robust role of international human rights law in Asia.
