This article assesses the impact of the ECHR and Convention rights of asylum seekers when they are destitute and have no other means or sources of support than the State. Among other things, it examines the important role being played by emergency orders directed at the Home Office which requires accommodation and support to be provided or maintained when refusal or withdrawal would give rise to a breach of article 3 and degrading treatment provisions.
